Terms and Conditions
These terms and conditions relate to the purchase by individuals or organisations of dogs and puppies from Elite Dobermans UK
The Puppy Purchase Agreement (“Agreement”) is made between Elite Dobermans UK and the individual or organisation purchasing the puppy pursuant to this Agreement (“Customer” and collectively, with Elite Dobermans UK, the “Parties”) for the purchase of the puppy identified by the Parties (“The Puppy”). Before any payment is made to Elite Dobermans UK the Customer should read, understand and accept these Terms and Conditions.
The puppy is sold as expressly set forth herein. The Customer should satisfy themselves as to size, colour, confirmation and markings of The Puppy before purchase as Elite Dobermans UK cannot guarantee how The Puppy will develop with age.
The following terms and conditions also apply to your purchase of The Puppy from Elite Dobermans UK:
Health of The Puppy
The Puppy is supplied to the Customer in as far as can be reasonably ascertained by Elite Dobermans UK in what should constitute good health. The Puppy will have been health checked by a licensed veterinarian prior to being imported and his or her health and wellbeing will have been closely monitored by Elite Dobermans UK whilst under the care of Elite Dobermans UK.
Puppy Value
The value of The Puppy for all purposes of this Agreement is limited to the purchase price of the puppy (the “Purchase Price”), and does not include, as applicable, taxes, shipping costs, veterinarian costs, shipping crate or any additional costs or expenses incurred or asserted by the Customer in connection with The Puppy.
Puppy Is a Pet, Show or Working Dog
All puppies are sold as pets, show or working dogs. The Customer agrees to care for The Puppy in a humane and responsible manner, including, but not limited to providing him/her with clean and adequate shelter, food, water and veterinary care.
Additional Photographs and Videos
Elite Dobermans UK will at their absolute discretion when requested by the Customer, provide additional photographs and/or videos of The Puppy during the period that falls between the Reservation Fee and/or Deposit Payment being made and the collection date. The provision by Elite Dobermans UK of photographs and/or videos is not a pre-requisite of this Agreement.
Accompanying Paperwork
Elite Dobermans UK agrees that on receipt of the full amount due in respect of the purchase of The Puppy and the Customer arriving to collect The Puppy, to provide The Customer with; an FCI issued 5th Generation Pedigree Certificate (original) – where applicable, EU Pet Passport modelled on Annex 1 of Commission Decision 2003/803/EC (original), Bill of Sale (copy), Puppy Purchase Agreement (copy) and Puppy Information Pack (original).
Microchip
The Puppy will be supplied with An ISO 11784/11785 compliant 15-digit non-encrypted pet microchip. The customer agrees to have The Puppy’s microchip details registered into their own name and address as soon as is reasonably practical. It is the sole responsibility of the Customer to, at the expense of The Customer, have the details of the microchip transferred into the Customers’ personal details.
Export Paperwork
Export paperwork will be provided at sole the discretion of Elite Dobermans UK. Under no circumstances, unless expressly agreed to in writing by Elite Dobermans UK, shall Elite Dobermans UK be obliged to provide export paperwork for The Puppy. The Customer agrees that The Customer is responsible for paying to Elite Dobermans UK in advance by means of cash or electronic bank transfer, any associated fees due in respect of the issuance of any export paperwork.
Website Information
Elite Dobermans UK makes every commercially reasonable effort to provide accurate and up-to-date information on www.ukdobermans.co.uk (the “Website”) regarding puppies sold by Elite Dobermans UK. Such information includes, but is not limited to, breed, gender, colour, date of birth, weight, parent’s titles and registration details.
Collection
The Puppy is to be collected by the Customer from Elite Dobermans UK licensed premises 14 days after the date of entry to the United Kingdom unless otherwise agreed by Elite Dobermans UK. Any delay caused by the Customer in respect of the collection of The Puppy will incur a £25 per day or part day charge. This fee will be due in addition to the agreed purchase price of The Puppy. Occasionally, a puppy may need additional time at Elite Dobermans UK kennels before leaving. The final determination of the leaving date for The Puppy is made by Elite Dobermans UK with the health of The Puppy being the primary determining factor. Occasionally, there may be delays for various reasons, including, but not limited to, weather, temperature restrictions, logistics, mechanical failure or other unforeseen events. Elite Dobermans UK shall not be liable, directly or indirectly, for any delays, including, without limitation, those that may cause the Customer inconvenience or financial loss, nor shall any delay be a valid cause for cancellation of the Customer’s purchase of The Puppy. The Customer understands and agrees that no refund shall be provided by Elite Dobermans UK due to any transportation delays or cancellations, whether such travel is domestic or international provided that these delays are kept within a reasonable minimum time frame.
Reservation Fee, Deposits and Cancellation
Deposits and Reservation Fees are subject to the Consumer Contracts Regulations 2013. Deposits and Reservation Fees can be paid in cash, via Paypal or by electronic Bank Transfer once agreement in principle has been made to purchase a puppy/dog. Should for any reason The Customer wish to cancel The Agreement to purchase, The Customer agrees that Elite Dobermans UK may withhold an amount equal to any costs incurred by Elite Dobermans UK involved in the importation, care and advertising costs for The Puppy. If, however Elite Dobermans UK are unable to provide The Puppy for any reason, Elite Dobermans UK agree to refund the Deposit or Reservation Fee in full no later than 28 days after the date it became apparent that Elite Dobermans UK were unable to fulfill the agreement to provide The Puppy. Please also note: all reservations are after Elite Dobermans UK private selection should Elite Dobermans UK wish to in rare cases, make a selection for itself.
Balance Payment
The Balance Payment is due upon collection of The Puppy. Under no circumstances will The Puppy be allowed to leave the possession of Elite Dobermans UK without the balance for The Puppy received in full. The balance is payable in cash or by electronic bank transfer. Paypal is not accepted for balance payments.
Warranties
Elite Dobermans UK disclaims any and all implied warranties of any kind however Elite Dobermans UK do agree that any puppy supplied by them will be as described in the advertisements for The Puppy and the details contained within the Elite Dobermans UK website.
Returns for Monetary Refund
Elite Dobermans UK will not accept any returns of The Puppy for monetary refund for any reason including, without limitation, allergies, landlord/tenant restrictions, marital issues, puppy adjustment problems, puppy behavior or any other reason. If, however a puppy sold by Elite Dobermans UK is deemed by a licensed veterinarian to have been ill at the point of sale and the likelihood is that Elite Dobermans UK would reasonably have been able to have identified this illness then Elite Dobermans UK agree to refund in full the purchase amount of The Puppy no later than 28 days after the receipt of The Puppy at Elite Dobermans UK kennels. Elite Dobermans UK will not be held responsible for any costs incurred by The Customer in respect of any illness The Puppy suffers unless it can be demonstrated that Elite Dobermans UK were aware at the point of sale of said illness.
Severability
If any provision, or provisions, of this Agreement is held to be illegal, invalid or unenforceable under applicable law by a court of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall continue in full force and effect and shall not in any way be affected or impaired thereby.
Entire Agreement
This Agreement represents the entire agreement between the Parties and no other Terms or Conditions shall be applicable to this sale.
